Terms of Service

Please read these Terms carefully. They include important provisions on intellectual property, purchases, services, disclaimers, limitation of liability, and dispute resolution.

1. Agreement

These Terms of Service ("Terms") govern your access to and use of nealwinsomerpublishing.com (the "Site"). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

2. Who We Are

The Site is operated by Neal Winsomer Publishing LLC ("we," "us," "our"), a limited liability company filed in the State of New Mexico with its principal place of business at 1333 College Pkwy #1037, Gulf Breeze, Florida 32563. Author Neal Winsomer is the sole member.

3. Eligibility

You may use the Site if you are at least 13 years old. If you are under 18, you may use the Site only with the involvement of a parent or legal guardian.

4. Use of the Site

You agree to use the Site only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use of the Site. Prohibited conduct includes:

  • Reproducing, copying, scraping, mirroring, framing, or republishing any portion of the Site without our written permission, except for personal, non-commercial use.
  • Attempting to gain unauthorized access to the Site, the server it is hosted on, or any related system.
  • Interfering with the Site's operation through malware, denial-of-service activity, or any similar means.
  • Using automated tools to harvest contact information, content, or other data from the Site for any commercial purpose.
  • Misrepresenting your identity or affiliation in any communication with us through the Site.

5. Intellectual Property

The Site and all content on it, including the text, graphics, logos, brand marks, photographs, audio, video, downloadable files, and the underlying code, are owned by Neal Winsomer Publishing LLC or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws.

In these Terms, "the book" means Calling Out the Shadows: A Father's Stand Against the Current in all of its editions and formats, including the paperback, hardcover, eBook, audiobook, large print edition, and the Skimmer's Edition. The book and the Skimmer's Edition derived from it are works of authorship by Neal Winsomer. All rights reserved.

You may quote brief excerpts from the Site for criticism, comment, news reporting, teaching, scholarship, or research consistent with the fair-use doctrine under 17 U.S.C. Section 107, provided you attribute the source as Neal Winsomer Publishing LLC and link back to the page you quoted from. Any other use, including reproduction of the book or substantial portions of it, requires our prior written permission.

The Neal Winsomer name, the Neal Winsomer Publishing name, the brand butterfly mark, the cover art for Calling Out the Shadows, and any associated designs are trademarks or trade dress of Neal Winsomer Publishing LLC.

6. User-Submitted Content

The Site does not currently accept public comments, reviews, or other user-submitted content. If you send us material through a contact form or by email, you grant us a limited, royalty-free, worldwide license to read and respond to it. We will not publish material you send us without your separate written permission.

If we add features in the future that allow public submissions, those features will have their own posted rules.

7. Purchases and Orders

Some items are available to buy directly on the Site, and others are sold through third-party retailers that we link to. Purchases you make through a third-party retailer (for example, Amazon, Apple Books, or another listed seller) are governed by that retailer's own terms and policies, not these Terms.

For items you buy directly from us:

  • Payment is processed by a third-party payment processor. We do not receive or store your full payment card number. Prices are shown in U.S. dollars, and any applicable taxes and shipping are calculated and shown before you complete your order.
  • We may decline or cancel an order, or correct a pricing or description error, before it ships. If we cancel an order you have already paid for, we will refund the amount you paid for that order.
  • Physical items are shipped to the address you provide. Delivery dates are estimates and are not guaranteed. Risk of loss for physical items passes to you when we deliver them to the carrier.
  • If a physical item arrives damaged or defective, contact admin@nealwinsomerpublishing.com within 30 days of delivery and we will arrange a replacement or a refund. You may return an undamaged physical item in its original condition within 30 days of delivery for a refund of the purchase price; return shipping is your responsibility unless the item arrived damaged or defective.
  • Digital items, including eBooks and audio files sold directly, are licensed to you for personal, non-commercial use, not sold, and are non-refundable once access has been delivered, except where a refund is required by law.

8. Services: Consulting, Speaking, and Protected Narrative Pathway Solutions

We offer, or will offer, consulting, speaking, and Protected Narrative Pathway Solutions services. Where these services are described on the Site, that description is for information only and is not an offer to form a professional relationship.

Each engagement is governed by a separate written services agreement between you and us. If anything in that agreement conflicts with these Terms, the services agreement controls for that engagement. Where you book or pay for a service through the Site, the payment and order provisions in Section 7 apply, and scheduling, deliverables, cancellation, and refunds are set by your services agreement.

Our services and all related content are provided for general support and education. They are not legal, medical, psychological, financial, or other professional advice, and they do not create an attorney-client, therapist-client, doctor-patient, or other licensed-professional relationship. For any legal, mental-health, custody, safety, or financial matter, consult a qualified professional in your jurisdiction.

We make no guarantee that you will achieve any particular result from any service, framework, or tool we provide.

9. Electronic Communications

When you use the Site, contact us, or sign up for our newsletter or email updates, you consent to receive communications from us electronically. If you subscribe to our newsletter or email list, we send those messages on the basis of your consent, and you can unsubscribe at any time using the link in any email or by emailing admin@nealwinsomerpublishing.com. How we handle the information you give us, including your email address, is described in our Privacy Policy.

10. Copyright Complaints

We respect the intellectual property rights of others. Nearly all content on this Site is our own work. If you believe something on the Site infringes your copyright, we want to hear from you and will review your concern promptly.

Because the Site does not host user-submitted content, we have not registered a DMCA Designated Agent with the U.S. Copyright Office, and the formal notice-and-takedown process under 17 U.S.C. Section 512 does not apply here. If we later add features that let visitors post content, we will register a Designated Agent and update this section.

To report a copyright concern, email admin@nealwinsomerpublishing.com or write to us at the address in Section 21. To help us look into it quickly, please include:

  • Identification of the work you believe is infringed.
  • The location on the Site of the material you are concerned about, with enough detail for us to find it.
  • Your name and contact information.
  • A statement of your good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.

If we agree that material infringes someone's rights, we will remove or correct it. A false or bad-faith infringement claim can carry liability under 17 U.S.C. Section 512(f); consider consulting an attorney before sending one.

11. Artificial Intelligence Disclosure

The book Calling Out the Shadows was written by Neal Winsomer over eight months of focused work. No narrative content was generated by artificial intelligence. The audiobook was recorded and narrated by the author. Grammar, formatting, and editing programs (including AI-assisted editing tools) were used for grammatical editing, proofreading, and consistency checks only.

For the Site itself, we may use AI-assisted tools for grammar, accessibility, search optimization, and similar production tasks. We do not publish AI-generated articles, biographies, or quotations attributed to the author. We disclose any future use of AI-generated visual or written content on the page where it appears.

We do not authorize the use of any content from this Site or from the book to train artificial intelligence or machine learning models without our prior written permission. This is an express reservation of rights, including any reservation available to us under applicable text-and-data-mining law.

12. Accessibility

We are committed to making the Site accessible to people with disabilities and target conformance with the Web Content Accessibility Guidelines (WCAG) 2.2 at the AA level. Accessibility is an ongoing effort, and some areas of the Site may not yet meet the target. If you encounter an accessibility barrier, contact admin@nealwinsomerpublishing.com and we will work to address it.

13. Third-Party Links and Services

The Site links to third-party services and platforms, including social media accounts, podcast distributors, retailers, press wires, and review sites. We do not control those third parties and are not responsible for their content, policies, or practices. Use of those services is at your own risk and is governed by their terms.

14. Disclaimers

The Site and its content are provided "as is" and "as available" without warranties of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, and uninterrupted or error-free operation.

The book Calling Out the Shadows is one father's account of his own experience and the framework he developed in response to it. It is not legal, medical, psychological, financial, or other professional advice. It is not a substitute for a lawyer, therapist, doctor, financial advisor, or other licensed professional. If you are dealing with a legal matter, a mental health concern, a custody dispute, a safety concern, or any other situation that requires professional help, consult a qualified professional in your jurisdiction.

References in the book and on the Site to behavioral patterns, communication patterns, and clinical concepts are descriptive observations drawn from the author's personal experience and contemporaneous records. They are not diagnoses, professional opinions, or findings of fact about any third party. We make no representation about whether any pattern described applies to any specific person or situation.

The book is a memoir and practical guide. References to communications, events, and patterns are based on the author's recollection and the author's contemporaneous records. Any resemblance to persons not specifically and intentionally identified is unintended, and no inference about any living person should be drawn from descriptive observations or composite illustrations used in the narrative.

Outcomes described in the book and on the Site are specific to the author's circumstances. We make no guarantee that you will achieve similar outcomes by reading the book, applying any framework discussed, or using any tool described.

Statements throughout the book and the Site that characterize behavior or motive are statements of the author's personal opinion based on his observations and his records. They are offered in good faith and are not asserted as objective findings against any third party.

15. Limitation of Liability

To the fullest extent permitted by law, in no event will Neal Winsomer Publishing LLC, Neal Winsomer, our affiliates, members, officers, employees, contractors, agents, suppliers, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including damages for lost profits, lost revenue, lost data, business interruption, personal injury, or emotional distress, arising out of or in connection with your use of the Site, the book, or our Services, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, even if we have been advised of the possibility of such damages.

In no event will our aggregate liability arising out of or in connection with the Site or these Terms exceed one hundred U.S. dollars ($100.00) or the amount you paid us in the twelve months before the claim, whichever is greater. Liability for a paid Services engagement is governed by the limitation set in your services agreement for that engagement.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

16. Indemnification

You agree to indemnify, defend, and hold harmless Neal Winsomer Publishing LLC, Neal Winsomer, and our affiliates, members, officers, employees, contractors, agents, suppliers, and licensors from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with: (a) your use of the Site, (b) your violation of these Terms, (c) your violation of any third-party right, including any intellectual property or privacy right, or (d) any content you submit to the Site.

17. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. You and we agree to the sole jurisdiction of the state courts located in Santa Rosa County, Florida, and the federal courts of the United States District Court for the Northern District of Florida, Pensacola Division, for any dispute arising out of or relating to these Terms or the Site, except where applicable law gives a consumer the right to bring a claim in their place of residence.

18. Dispute Resolution

Before filing any lawsuit, you agree to first contact us at admin@nealwinsomerpublishing.com with a clear description of the dispute and the resolution you are seeking, and to allow us thirty (30) days to respond and attempt to resolve the matter informally. This requirement does not prevent either party from seeking emergency injunctive relief or from pursuing claims in small-claims court.

19. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page shows when the most recent change was made. If we make material changes, we will post a notice on the Site. Your continued use of the Site after changes are posted constitutes your acceptance of the updated Terms.

20. Severability and Entire Agreement

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect, and the invalid or unenforceable provision will be modified to the minimum extent necessary to make it enforceable.

These Terms, together with our Privacy Policy and any separate services agreement you enter into with us, constitute the entire agreement between you and us regarding the Site and supersede any prior agreements on the same subject.

No waiver by us of any term or condition will be deemed a further or continuing waiver of such term or any other term.
